General conditions

  1. The goods are sold as seen with no warranty, representation or condition implied or stated concerning the goods and, in particular without limitation, Equipped4U B.V. makes no warranty as to fitness for purchase, value, operation or performance. All warranties, obligations and liabilities of any kind, whether in contract, tort or otherwise are expressly excluded to the maximum extent permitted by law.
  2. Payment of the price shall be made without any set-off, counterclaim, deduction or withholding.
  3. Title to the goods shall pass to the Buyer upon payment in full. If payment is made by check, title shall not pass to the Buyer until the check has been honored. Trailers not paid for and collected within 14 days of invoicing will incur storage charges in accordance with Equipped4U normal practice
  4. The Buyer shall remove and transport the goods at its own expense after receipt of title and shall indemnify Equipped4U B.V. in respect of any damage caused to third parties thereby.
  5. Promptly after title to the goods passes to the Buyer, the Buyer shall remove all former Company decals, logos, livery etc. form the goods.
  6. Risk in the goods shall pass to the Buyer upon title passing or upon earlier collection of the goods if agreed by Equipped4U B.V..
  7. Equipped4U B.V. shall not be liable for any loss, injury or damage whatsoever sustained by reason of any defect in the goods, whether such defect is latent or apparent on examination of the goods, such exclusion having effect to the maximum extent permitted by law
  8. The Buyer indemnifies Equipped4U B.V. against all claims for damages (a) in consequence or arising out of any defect in the goods, and (b) for any other reason whatsoever after Buyer takes title to the goods.
  9. The Buyer acknowledges that it complies with all laws and regulations applicable to the sale, purchase, and use of the good in all countries which have or may have jurisdiction over the goods. The Buyer also acknowledges that i twill comply wit hall applicable regulations advised by the UN.
  10. The invoice will be governed by Dutch law in the Netherlands and the Dutch courts will have jurisdiction to settle any dispute arising out of this invoice.
